Privacy Policy

This Privacy Policy explains how Choke Spots ("we", "us", "our") collects, uses, and shares information when you use the website at chokespots.com and the related appointment-monitoring and booking service (the "Service"). By using the Service you agree to this Policy.

1. Information we collect

You give us:

Account / identity from sign-in. When you sign in with Google, Apple, or an email magic-link, we receive your email address and a display name from that provider. (Apple may provide a private relay email.)
Legal name. The legal first and last name of the person the appointment is for, confirmed explicitly - required so the booking matches the DMV's identity record for that person.
Phone number. Required for the DMV booking and, if you opt in, for text notifications.
Appointment-specific identifiers. Some appointment types require more than name and phone - in particular, road-test bookings also require the person's date of birth and permit number. We collect only the identifiers the specific booking actually needs.
Booking criteria. What you tell our assistant ("Leo") - the service type, preferred location(s), and date/time window you'll accept.
Payment information. When you save a card on file, our payment processors collect and store your card/payment details. We do not receive or store full card numbers; we keep only a processor token and limited metadata (e.g., card brand and last four digits).
SMS consent. Whether you opted in to texts and whether you verified your number.

We collect automatically:

Usage & device data - log data, IP address, browser/device type, pages viewed, and actions taken, used to operate and secure the Service.
Cookies / similar technologies - for authentication (keeping you signed in) and basic analytics. You can control cookies through your browser.

What we do not collect:

We ask only for what a booking actually requires - for most appointments that is just legal name and phone, and road-test bookings also require date of birth and permit number. We do not collect DMV documents, copies or scans of IDs, or anything a booking does not need.

2. How we use information

To provide the Service - parse your criteria, monitor availability, and book an appointment on your behalf using your legal name and phone number.
To cancel an existing DMV appointment only when you expressly authorize us to.
To charge the $29 fee off-session upon a successful qualifying booking.
To notify you in-app, by SMS (if you opted in and verified), and by email (booking receipt and account messages).
To provide customer support, prevent fraud and abuse, secure the Service, and comply with law.

We rely on your consent (e.g., SMS opt-in), the performance of our contract with you (booking and charging), and our legitimate interests (security, fraud prevention, improving the Service) as our bases for processing.

3. Who we share information with

We share only what each recipient needs to perform its function. We use the following categories of service providers and recipients:

AI assistant provider (Anthropic)	The text of your chat with Leo (your stated criteria).	To parse your appointment criteria.
Sign-in providers (Google, Apple)	Authentication data.	To let you sign in.

We may also disclose information to comply with law, enforce our Terms, protect rights and safety, or in connection with a business transfer (merger, acquisition, or sale of assets).

We do not sell your personal information, and we do not share it with third parties for their own marketing.

4. SMS / text messaging consent (A2P 10DLC)

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use-case categories exclude text-messaging originator opt-in data and consent; this information will not be shared with any third parties.

You opt in to texts by checking the SMS box during booking setup (and/or at chokespots.com/sms-optin). We send automated transactional messages (appointment-match alerts and booking confirmations). Message and data rates may apply; message frequency varies. Reply STOP to opt out and HELP for help. Opting out of SMS does not stop in-app or email notifications.

5. Data retention

We keep your information for as long as your account is active and as needed to provide the Service, then for a reasonable period afterward to meet legal, accounting, tax, fraud-prevention, and dispute-resolution obligations. We delete or de-identify information when it is no longer needed.

6. Security

We use industry-standard safeguards (encryption in transit, access controls, tokenized payments via PCI-compliant processors). No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

7. Your choices & rights

Access / correction / deletion. You may request a copy of your information, correct it, or ask us to delete it by emailing david.cito.rodrigues@gmail.com. Some data may be retained as required by law or for legitimate business needs.
SMS. Reply STOP to opt out of texts at any time.
Marketing email. Use the unsubscribe link (transactional messages, like booking receipts, may still be sent).
Cookies. Manage through your browser settings.

Depending on your residency (e.g., California), you may have additional rights to know, delete, and opt out of "sale"/"sharing" of personal information. As stated above, we do not sell personal information. To exercise any right, contact david.cito.rodrigues@gmail.com.

8. Children

You must be at least 15 to use the Service. We do not verify age - the DMV verifies identity and eligibility at the appointment - and we do not knowingly collect information from children under 13. Because many DMV appointments (learner's permits, road tests) are for teenagers, the Service supports both teens booking for themselves and adults booking for a minor. When an appointment is for someone else, the account holder provides and confirms that person's information - for a road test, the minor's legal name, date of birth, permit number, and a contact phone - which we use only to book or cancel that appointment and share only with the DMV.

9. Changes

We may update this Policy. We will revise the "Last updated" date and, for material changes, provide additional notice where appropriate.
